Beulah Kugler Widuk, a member of Local 1607 of the International Brotherhood of Electrical Workers, AFL-CIO, alleging she
had been wrongfully discharged by the defendant The John Oster Manufacturing Co., brought this action for reinstatement of
her employment, restoration of her seniority rights and back pay. The answer denied the wrongful discharge and pleaded in
abatement the failure of the plaintiff to exhaust her remedies through the grievance procedures under the union contract.
The case was tried to a jury which found in a special verdict that the discharge of the plaintiff was an unreasonable exercise
of the defendant's authority under the contract and the plaintiff had exercised due diligence in attempting to become reinstated. On motions after verdict, the trial court denied the defendant's motion to change the answers to the verdict, but granted
its motion to dismiss the complaint notwithstanding the verdict on the ground the defendant had the right to discharge the
plaintiff whether the exercise of the right was reasonable or not. From the judgment dismissing the complaint, the plaintiff
appeals.
